1. Introduction and Acceptance of Terms
Welcome to Next Girl Up Soccer Academy. These Terms of Service ("Terms") govern your access to and use of our website, services, and programs operated by Next Girl Up, a sole proprietorship owned by Paul Okumu ("we," "us," or "our").
By accessing or using our website, creating an account, registering for programs, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

2. Account Registration and Requirements
2.1 Account Creation
To use our services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Be a parent or legal guardian of the child(ren) you wish to register
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
2.2 Account Requirements
- Each account must have a unique email address
- One email address corresponds to one parent/guardian account
- You must add at least one player (child) to your account before accessing the main dashboard
- You are responsible for all activities that occur under your account
2.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.
3. Player Information Management
3.1 Adding Players
You may add multiple players (children) to your account. When adding a player, you must provide accurate and complete information, including medical information necessary for the safety and well-being of participants.
3.2 Editing Restrictions
Important: Once a player is added to your account, the player information cannot be edited or deleted through the website. This restriction is in place to maintain data integrity and registration history. If you need to correct player information, please contact us at nextgirlup@gmail.com.
3.3 Accuracy of Information
You are responsible for ensuring that all information provided about yourself and your children is accurate, complete, and up-to-date. Providing false or misleading information may result in the cancellation of registrations and termination of your account.
4. Program Registration Policies
4.1 Camp Programs
- Camps are multi-day programs with fixed start and end dates
- Each camp has a single fixed price regardless of duration
- Only active camps with future start dates are available for registration
- You may register multiple players for the same camp in a single transaction
- Registration is confirmed only after successful payment
4.2 Private Training Programs
- Private training sessions are one-hour sessions that are always available
- Default configuration is 1-on-1 training (1 attendee)
- You may include additional attendees, up to a maximum of 5 total attendees
- Price is calculated as: Base price × Total number of attendees
- You may include existing players from your account as part of the group
- Registration is confirmed only after successful payment
4.3 Registration Eligibility
Programs are designed for youth girls. You must ensure that any child you register meets the age and skill requirements specified for each program. We reserve the right to refuse registration or remove participants who do not meet program requirements.
5. Payment Terms and Conditions
5.1 Payment Processing
- All payments are processed securely through Stripe, a third-party payment processor
- Payment is required at the time of registration
- We accept major credit and debit cards through Stripe
- Payment information is collected and processed by Stripe, not stored on our servers
- You will receive an email receipt from Stripe upon successful payment
5.2 Pricing
- All prices are displayed in Canadian dollars (CAD) unless otherwise stated
- Prices are subject to change without notice, but changes will not affect registrations already completed
- Discounts may be automatically applied based on your registration history
- The final price, including any discounts, will be displayed before you complete payment
5.3 Payment Authorization
By providing payment information, you authorize us to charge the specified amount to your payment method. If payment cannot be processed, your registration will not be confirmed.
6. Refund and Cancellation Policies
6.1 Cancellation by You
If you wish to cancel a registration, you must contact us at nextgirlup@gmail.comas soon as possible. Cancellation requests are subject to our refund policy.
6.2 Refund Policy
- Refunds are processed manually by administrators on a case-by-case basis
- Refund eligibility depends on the timing of the cancellation request and program start date
- Refunds, if approved, will be processed through Stripe to the original payment method
- Processing time for refunds may take 5-10 business days
- We reserve the right to refuse refunds for registrations cancelled after the program start date, except in exceptional circumstances
6.3 Cancellation by Us
We reserve the right to cancel or reschedule programs due to insufficient enrollment, weather conditions, facility issues, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to transfer your registration to another program.
7. Liability Waivers and Limitations
7.1 Assumption of Risk
Participation in soccer programs involves inherent risks, including but not limited to physical injury, illness, or property damage. By registering for our programs, you acknowledge and assume all risks associated with participation.
7.2 Waiver of Liability
To the fullest extent permitted by law, you, on behalf of yourself and your registered children, release, waive, and discharge Next Girl Up, Paul Okumu, and their employees, agents, and representatives from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from or related to participation in our programs, including but not limited to:
- Personal injury or death
- Property damage or loss
- Illness or medical conditions
- Acts or omissions of other participants or third parties
7.3 Limitation of Liability
To the maximum extent permitted by applicable law, our total liability for any claims arising from or related to our services shall not exceed the amount you paid for the specific program giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
7.4 Medical Emergency Authorization
By registering for our programs, you authorize Next Girl Up and its staff to obtain emergency medical care for your child if necessary, and you agree to be responsible for all costs associated with such care.
8. Code of Conduct and Program Rules
8.1 Participant Conduct
All participants and their parents/guardians are expected to:
- Treat all participants, staff, and volunteers with respect and courtesy
- Follow all instructions from program staff
- Maintain appropriate behavior during programs
- Respect facility rules and property
- Refrain from any form of harassment, bullying, or discrimination
8.2 Consequences of Misconduct
We reserve the right to remove any participant from a program, without refund, if their behavior (or the behavior of their parent/guardian) is disruptive, unsafe, or violates our code of conduct.
8.3 Attendance and Punctuality
Participants are expected to attend all scheduled sessions and arrive on time. We are not obligated to provide make-up sessions for missed classes, except in exceptional circumstances at our discretion.
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Next Girl Up or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.
By submitting photos, videos, or other content to us (including through photo/video permissions), you grant us a non-exclusive, royalty-free license to use such content for marketing and promotional purposes.
10. Prohibited Uses
You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any laws or regulations in your use of our services
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to any part of our website or systems
- Use automated systems to access our website without permission
- Impersonate any person or entity
- Collect or harvest information about other users
11. Dispute Resolution
11.1 Informal Resolution

11.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
11.3 Jurisdiction
Any disputes arising from or related to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Next Girl Up regarding your use of our services and supersede all prior agreements and understandings.
